If we make changes, we will notify you by revising the date at the top of this policy, and in some cases, we may provide additional notice (such as adding a statement to the homepage of our website or sending an email notification). Capitalized terms not defined herein shall have the meanings ascribed thereto in our Terms of Service.

Text Marketing:
With your permission, we may send text messages about our store, new products, and other updates. Updates may include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system.

Your Information Choices and Control

Shepherd of 23 respects your need to access and control your Personal Information, so we provide you with the following choices:

  • You may correct, update, and delete your account.
  • You may change your preferences for subscriptions, newsletters, and alerts.
  • You may choose whether to receive offers and promotions for our products and services, or products and services that we think may be of interest to you.

Please note that we may be required to keep such information and not delete it (or keep it for a certain time), in which case we will comply with your deletion request only after fulfilling these requirements. When we delete any information, it will be removed from the active database, but residual copies may remain in our Site’s back-up systems due to the nature of those systems’ operations.
  • We may also retain your information for fraud prevention or similar purposes.

Security

We take reasonable measures to help protect information about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. We use organizational, procedural, and technical safeguards to secure data in our possession, consistent with the sensitivity level of such data. When sensitive information (such as credit card data) is collected on our Site, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol, and may be processed by third parties using similar levels of protection. However, no transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under our control to intercept or access transmissions or private communications unlawfully. While we strive to protect Personal Information, we cannot ensure or warrant the security of any information you transmit to us.

Children's Privacy

We do not knowingly collect any Personal Information from children under the age of 16. We do not sell products for purchase by children, and all children’s products we sell are intended for purchase by adults only. If we learn that we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. This California Privacy Notice supplements the information in Shepherd of 23's privacy policy and applies only to California residents.

This notice is provided pursuant to the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA), including any associated regulations. Terms used in this California Privacy Notice have the same meaning as provided in the CCPA, CPRA, and related regulations, unless otherwise defined.


Exercising Your California Privacy Rights

As a California resident, you have the following rights regarding your Personal Information:

(1) Right to Know: You can request information about the Personal Information we collect, use, disclose, and sell, including the categories and specific pieces of Personal Information we have collected about you.

(2) Right to Delete: You can request that we delete the Personal Information we have collected about you.

Verifying Your Requests

We will take reasonable steps to verify your identity based on the information you provide and the type of request you are making.

In your request, you must provide enough information to allow us to verify that you are the person about whom we collected Personal Information, or their authorized representative. You must also describe your request in sufficient detail so that we can understand, evaluate, and respond to it. If we cannot verify your identity, we may not be able to fulfill your request. Making such a request does not require you to create an account with us, and we will only use the information you provide in the request to verify your identity.

Submitting a Request

Only you, or a person registered with the relevant authorities that you authorize to act on your behalf, may make a request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of a California resident who wishes to make a request.

We may not be able to respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will ask you for the email information you used to interact with us or sign up for a loyalty program, receive emails, or make purchases, to help verify your identity or authority to make the request and confirm that your information is in our system. Any information provided to submit a request will only be used for verification and request purposes.

Timing

We will make best efforts to respond to a verified consumer request within 45 days. If we need more time, we will inform you in writing of the reason and the extension. You may only make a request for access or data portability twice within a 12-month period.

Information We Collect

Shepherd of 23 collects and uses your information for the purposes described in this Privacy Policy, which include "business purposes" under the CCPA and CPRA. We do not sell your personal information for monetary consideration. However, California law may categorize our sharing of personal information with companies that provide services to us (such as those that help us market or advertise our products and services to you) as "sales." We may "sell" or may have "sold" the following categories of personal information for valuable consideration, as listed in the table below.

Our Site collects Personal Information, which is information that identifies, relates to, describes, references, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device. Disclosure of Your Information

We do not sell, trade, or rent Users' Personal Information to others, and we have not done so during the preceding twelve (12) months.

We may disclose your Personal Information to third parties for a business purpose. When we disclose Personal Information for a business purpose, we enter into contracts that describe the purpose and require the recipient to keep that Personal Information confidential and not use it for any purpose except performing the contract.

We share your Personal Information with the following categories of third parties:

  • Subsidiaries and affiliates.
  • Contractors and service providers who assist us with business operations, such as payment processing, shipping, and customer service.

Right to Delete

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

Right to Correct Inaccurate Information

Right to Limit the Use and Disclosure of Sensitive Personal Information

We do not use or disclose sensitive personal information other than to provide you with our services as permitted by California law. Shepherd of 23 does not sell or share sensitive personal information for the purpose of cross-context behavioral advertising.

We collect sensitive personal information based on one or more of the following legal grounds:

  • You have given explicit consent to the collection for one or more specified purposes;
  • Where the collection of sensitive personal information is manifestly made public by you; and/or
  • Where the collection is necessary for the exercise or defense of legal claims.

Right to Opt-Out of Sharing

California consumers have the right to opt out of the sharing of their Personal Information or Sensitive Personal Information to a third party for cross-context behavioral advertising (i.e., targeted advertising), whether or not for monetary or other valuable consideration.

Right to Opt-Out of Sale

California consumers have the right to opt out of the sale of their Personal Information or Sensitive Personal Information.

Making Requests to “Opt-Out” of the “Sale” or “Sharing” of “Personal Information”

If you are a California consumer and would like to submit a request to opt out of the sale or sharing of your personal information, you may click on the link “Do Not Sell or Share My Personal Information” in the footer of our site or choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). Shepherd of 23 engages in online advertising practices (and certain analytics or similar activities), which may be considered a “sale” or “share” for cross-context behavioral advertising under the CCPA and CPRA. Non-Discrimination

We will not discriminate against you for exercising any of your CCPA and CPRA rights. Unless permitted by the CCPA and CPRA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Notice of Financial Incentive

Under California regulations, certain programs we offer that provide benefits to consumers may be considered financial incentive programs. We may collect personal information from you in connection with these programs, such as contact information (name, email address, residential address) and certain commercial information for various reasons, including administering the program, contacting you regarding your account (if any), providing the benefits to you, serving you better, and fulfilling your requests associated with the program.

To opt-in to these programs, you may need to provide certain information, register for an account, agree to the applicable program terms, or follow the instructions associated with the program. Please also refer to the terms of the program you are joining for further details. Participation in our programs is voluntary, and you can withdraw at any time.

To the extent that we provide a program that may be considered a financial incentive because it is directly or reasonably related to the collection, deletion, or sale or retention of consumer personal information, the value is reasonably related to the overall value we receive from the personal information participants provide specific to the program, minus the costs and expenses we incur in providing the program.

Other California Privacy Rights

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Notice To Nevada Residents

Pursuant to Nevada law, you have the right to opt-out of the sale of certain covered Personal Information we have collected about you through our Site. Please note that Shepherd of 23 does not sell your covered information as those terms are defined under applicable Nevada law. However, you may still submit an opt-out request and we will honor that request as required by Nevada law if we were to engage in such a sale in the future. Notice to Virginia Residents
